For media clients, Brodie provides advice relating to both pre-publication and post-publication issues covering matters such as copyright, defamation and broadcast restrictions under regulatory codes. He also advises on advertising and marketing legal requirements on a range of topics including therapeutic goods regulation and compliance under the Australian Consumer Law.
Brodie regularly advises gambling and gaming industry clients on both regulatory and commercial matters. In particular, he provides advice to gambling and gaming operators concerning advertising and marketing compliance, licensing, policy and consumer protection. He has also advised a number of online bookmakers and affiliates in relation to regulatory investigations and criminal prosecutions under gambling advertising laws, both at the state and federal level.
Brodie has litigation experience and has acted for clients in a number of courts and jurisdictions relating to copyright and trade mark infringement, gambling, administrative law, defamation and commercial disputes.
Publishers — regularly provide advice to a number of media publishers including Seven Network, AAP, Sky News, WPP ANZ and Free TV on pre-publication issues involving defamation, contempt, copyright and compliance with regulatory codes. Acting in defamation proceedings and investigations by the ACMA.
Hungry Jack’s — acting for Hungry Jack’s in Federal Court proceedings commenced by McDonald’s alleging that Hungry Jack’s BIG JACK trade mark infringes the BIG MAC trade mark. McDonald’s also claims that Hungry Jack’s claim that the BIG JACK contains 25% more Aussie beef than the BIG MAC is misleading and deceptive.
Lottoland Australia — acting for Lottoland Australia in proceedings before the NT Supreme Court and Court of Appeal to challenge the imposition of certain licence conditions.
Gambling operators — advise numerous online bookmakers and affiliates in relation to compliance with Australian gambling laws and regulations. In particular, Brodie provides advice to online bookmakers and their affiliates in relation to advertising and marketing on all platforms and across all mediums, including online, television, radio and sponsorships.
Gaming and entertainment — provide advice in relation to the regulation and classification of new and emerging technologies and gaming applications. Clients include video game developers and publishers, technology companies, suppliers of gaming software and online streaming services.
