In Australia, employment is primarily regulated by legislation at the Federal level. There are some areas, notably long service leave, which continue to be regulated at the State level.
The primary piece of Federal legislation is the Fair Work Act 2009 (Cth) (the FW Act). The FW Act applies to most businesses operating in Australia.
The FW Act, among other things:
- sets out the National Employment Standards; and
- creates the framework for modern awards and enterprise agreements.
