Addisons acted for S.C. Johnson & Son in relation to proceedings commenced in the Federal Court by RB (Hygiene Home) Australia Pty Ltd on Friday 4 December 2020.
RB challenged various of the advertising claims made by S.C. Johnson on its Raid Max Double Nozzle insect spray packs, its TVC featuring the wonderful ‘Steve’ and some point of sale and website material claiming they were misleading and deceptive.
The matter was heard on 9 December. On 11 December, the Federal Court held that RB’s application be dismissed with S.C. Johnson’s legal costs to be paid by RB.
“Over the course of five intense days, we threw a talented team led by partner, Martin O’Connor, and Special Counsel, Hayden Martin, and with the fabulous advocacy of Kevin Andronos SC and assistance of Tom Hollo, at this matter and successfully defended S.C. Johnson’s right to continue to advertise its Raid Max products throughout the peak insect season in Australia. We are thrilled with this result for our client.”
