Our Trade Marks team acts across the full brand protection lifecycle, from managing trade mark portfolios through to brand disputes. We offer expert assistance in all trade marks matters, from advising on registrability, clearance searches and prosecution through to contentious issues, such as multi-party oppositions, non-use removals and litigation.
We also have significant experience in disciplines associated with brand protection, exploitation and enforcement including advising and acting in relation to misleading and deceptive conduct and passing off disputes, particularly in relation to product branding, advertising and marketing. We also routinely advise on Trade mark-related commercial agreements such as agreements transferring or licensing trade marks; brand sponsorship agreements; advertising and marketing agreements.
acted for Hemmes Trading Pty Limited, a company in the Merivale Group, in Federal Court proceedings against Establishment 203 Pty Ltd in respect of infringement of our client’s ESTABLISHMENT trade mark as well as claims of misleading and deceptive conduct and passing off.
acted for Hungry Jack’s defending its BIG JACK hamburger in infringement proceedings commenced by McDonald’s regarding its BIG MAC trade mark.
acted in Federal Court proceedings against Stockland for trade mark infringement and contraventions of the Australian Consumer Law.
