Addisons’ Environment and Planning team are highly experienced litigators. Our lawyers regularly appear in the Land and Environment Court and we have run key cases and achieved successful outcomes for clients in that jurisdiction.
Our lawyers’ experience includes running matters in the Class 1 (development and residential development appeals), Class 2 (trees), Class 3 (compulsory acquisition and valuation) and Class 4 (administrative law and judicial review) jurisdictions.
We have succeeded in obtaining development consents for clients for projects including houses, townhouses, residential flat buildings, mixed-use buildings, commercial buildings, roads, parks, and subdivisions.
In compulsory acquisition matters, we have obtained substantial compensation for clients. We have successfully defended judicial review cases brought by objectors and community interest groups seeking to overturn rezonings and development consents. We have also acted in numerous civil and criminal enforcement proceedings.
assisted AVID obtain development consents for a residential subdivision through NSW Land and Environment Court development appeals.
represented a developer landowner in an appeal by a former owner in respect of a management order issued by the NSW Environment Protection Authority for the remediation of contaminated soil and groundwater. The appeal was resolved by the parties resulting in a voluntary remediation agreement.
acted for Dial A Dump, Coombes Property Group, City of Sydney Council, Inner West Council, Mirvac, Stockland, Pacific Bay Resort and others in relation to valuation and compensation appeals, many of which resolved prior to hearing.
acted for a property developer in defending a legal challenge brought by a neighbouring owner to the rezoning and approval of its development in Parramatta. The matter was settled prior to hearing.
assisted WINIM obtain development consents through the NSW Land and Environment Court for residential developments in Kirribilli, Neutral Bay, Gordon, Mosman and Northbridge.
