Addisons advises Norco

Addisons was pleased to advise Norco Co-operative on the recent matter which saw the Australian Competition and Consumer Commission (ACCC) and Coles agree that Coles would pay Norco approximately $5.25M for distribution to Norco’s farmers, with about $2.8M payable by 12 December 2019 and the balance payable by 30 June 2020.

The ACCC had alleged that Coles engaged in misleading and deceptive conduct by representing on its 2L and 3L Coles branded milk, which was supplied by Norco, that a 10 cents per litre price rise for those products would be passed onto farmers, when this was not the case.

“Instead of the delay and uncertainty associated with the ACCC pursuing Coles in Court, the ACCC and Coles agreed an innovative solution. This will see Coles pay a substantial amount to Norco for distribution to its farmers within 7 days and the balance paid over the next 6.5 months.”
